1. Who we are
betterjobs ("betterjobs", "we", "us") is a candidate outreach service operated by Zen Tech LLC, a Delaware limited liability company. It helps you find professionals who match a role, write personal emails to them, send those emails from managed mailboxes and manage the replies.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. The service is for business use only. If you use it on behalf of a company, you confirm that you are authorised to accept these terms for that company, and "you" refers to both you and the company.
3. Your account
You sign up with a company email address. You are responsible for keeping access to your account secure, for all activity under it and for keeping your details accurate. Tell us straight away at support@mailscale.ai if you believe your account has been compromised. Team members you invite are bound by these terms and you are responsible for their use.
4. Free drafts and free trial
- Drafting a campaign is free. Nothing is sent to any candidate until you launch.
- Launching starts a free trial of the length shown at checkout. A valid payment method is required to start it.
- Unless you cancel before the trial ends, your subscription starts automatically and your payment method is charged the price shown at checkout.
- One free trial per company. We may refuse or end a trial that we believe is being abused, for example through multiple accounts.
5. Subscriptions, credits and billing
- Paid plans are billed in advance and renew automatically at the end of each billing period until cancelled.
- Credits are used as candidates are contacted. One credit contacts one candidate. Unused plan credits and purchased credit packs are handled as described at the time of purchase.
- You can cancel at any time in your account settings. Cancellation takes effect at the end of the current billing period.
- Prices may change. We will tell you in advance, and the new price applies from your next billing period.
- Payments are processed by our payment provider. You authorise us to charge your payment method for all fees due, plus any applicable taxes.
6. Refunds
Fees are non-refundable, including for partial periods, unused credits, early cancellation, failure to cancel before renewal or lack of results, except where the law requires otherwise. If you think you were charged in error, contact support@mailscale.ai before opening a chargeback. Chargebacks opened without contacting us first may lead to suspension of your account.
7. How you may use betterjobs
You agree to use the service lawfully and in line with our Acceptable Use Policy. In particular, you are responsible for:
- Advertising real roles only, with accurate information about the employer, the role and its conditions.
- Complying with the laws that apply to your outreach and hiring, including CAN-SPAM, CASL, GDPR and UK GDPR, the ePrivacy rules of the recipient's country and employment and anti-discrimination law.
- Having a lawful basis to contact each candidate and honouring every request to stop contacting them.
- The content of your campaigns, including text suggested by our AI that you approve or send.
8. Candidate data
Candidate contact details are sourced from third-party business data providers and are made available to you only to run recruiting outreach through betterjobs. You may not export, resell or use them for any other purpose. For the campaigns you run, you decide who is contacted and why, and you act as the controller of that personal data. We process it on your behalf as described in our Privacy Policy.
9. AI generated content
betterjobs uses AI to analyse job posts, suggest audiences and draft emails. AI output can be inaccurate or incomplete. Review everything before you launch. You are responsible for the content you send.
10. Sending and deliverability
We send your campaigns from mailboxes we manage and we work to keep them in good standing. We do not guarantee inbox placement, reply rates, interested candidates, hires or any other result. Estimates shown in the product are illustrations, not promises. We may pause or limit sending to protect deliverability or to comply with the law.
11. Intellectual property
We own the service, including its software, design, templates and brand. We grant you a limited, non-exclusive, non-transferable right to use it during your subscription. You keep ownership of the content you upload or write. You grant us the rights we need to host, process and send it in order to provide the service. You may not copy, reverse engineer or resell the service, or use it to build a competing product.
12. Third-party services
The service relies on third parties for hosting, payments, email delivery, data and AI. Integrations you connect, such as Slack or webhooks, are governed by the terms of those providers. We are not responsible for services we do not control.
13. Suspension and termination
You can stop using the service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these terms or the Acceptable Use Policy, create risk for other customers, our mailboxes or our providers, fail to pay, or if the law requires it. On termination your right to use the service ends and unused credits are forfeited.
14. Disclaimers
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
16. Indemnity
You will defend and indemnify Zen Tech LLC against claims, losses and costs arising from your campaigns, your content, your breach of these terms or your violation of any law or third-party right.
17. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. The state and federal courts located in Delaware have exclusive jurisdiction, unless mandatory law in your country says otherwise.
18. Changes
We may update these terms. If a change is material we will notify you by email or in the product before it takes effect. Continuing to use the service after that means you accept the updated terms.
